Terms of Service Agreement
Introduction
It is common practice for naturopaths, nutritionists, and other non-medically licensed practitioners to collect your signature on a form such as this. By doing so, you acknowledge and accept that the services provided by Michele Scarlet Inc. are non-medical and educational in nature. You further acknowledge and accept that we:
● do not provide medical diagnosis or treatment
● are not a substitute for advice from a qualified medical doctor
● recommend that you consult your doctor before making any changes to your diet, exercise regime, or supplementation
● do not warrant the accuracy of any information provided as we are not the originators of the information
● are not liable for any losses you may suffer by relying on any advice we provide
● do not recommend any particular product or service
● do not guarantee specific results within a fixed timeframe
● are not a covered entity or business associate under HIPAA
● are unable to provide any diagnosis or CPT codes for insurance billing purposes
By adding your signature below and/or instructing us to provide services, you indicate your agreement to these terms.
What We Do and Do Not Do
We obtain laboratory test results on your behalf from certified laboratories and provide a holistic or nutritional interpretation for educational purposes only. These interpretations are not intended to diagnose, treat, or cure any disease or condition. Your doctor may use these same reports for medical purposes; however, we do not. The information we provide is not intended to, cannot, and should not be a substitute for a personal consultation with your qualified doctor. We may provide you with information about products that we believe might benefit you; however, such information is not to be interpreted as an endorsement or recommendation. Some products may require a prescription, which we do not provide. All information provided is intended for educational purposes only and should not be taken as professional medical advice or used as a substitute for medical care. We are not responsible for any adverse effects or consequences
that may result, either directly or indirectly, from that information. We will make reasonable efforts to protect your personal health information; however, this information is not covered by doctor-patient confidentiality or governed by HIPAA.
Medical Services and Prescribing
Any medical services, including but not limited to consultations, diagnoses, or prescriptions provided by a licensed medical provider, are delivered independently of Michele Scarlet Inc. For the purposes of this Agreement, a “licensed medical provider” may include a Medical Doctor (MD), Nurse Practitioner (NP), or other regulated healthcare professional operating within their legal scope of practice.
Any such services are provided under a separate practitioner-client relationship between the Client and the licensed medical provider. Michele Scarlet Inc. does not control, direct, or assume liability for any medical advice, prescriptions, or treatment decisions made by a licensed physician. The Client acknowledges that any prescriptions, therapies, or medical recommendations are solely the responsibility of the prescribing medical provider and that Michele Scarlet Inc. is not responsible for any
outcomes, side effects, or results related to such medical services
Consult Your Doctor
We are not qualified medical advisors and make no claims to be so. The information we provide should not be taken as and is not a substitute for personal medical advice and instruction. You should not take any action based solely on our advice or guidance.
You should consult your doctor:
● for medical interpretation of your lab test results
● regarding your health and well-being
● before making any changes to your exercise routine or diet
● before taking any nutritional, herbal, homeopathic, or hormonal supplementation
● before beginning any therapy or modality
Laboratory Testing and Supplement Costs
The Client acknowledges and agrees that the COREFIT 90 Day Metabolism Reset Program includes the cost of an initial set of laboratory testing as outlined at the time of purchase. The Client agrees to the program fees, payment terms, and billing structure as presented and accepted at the time of purchase, whether through checkout, invoice, or written agreement.
The Client further understands and agrees that:
● any additional or follow-up laboratory testing recommended beyond the initial testing is not included in the program fee and is the sole responsibility of the Client
● all supplements, products, or protocols recommended are not included in the program fee and are optional
● the purchase of any supplements or products is at the Client’s sole discretion and expense
● additional laboratory testing may be recommended based on individual progress and needs
● supplement protocols are individualized and may change over time
Michele Scarlet Inc. makes no guarantees regarding the effectiveness of any laboratory testing, supplement, or product.
Exclusion of Warranties
We will provide our services with reasonable care and skill; however, we make no other warranty, express or implied, with respect to those services. All other warranties are excluded to the maximum extent permitted by law. We make no warranty as to the accuracy of laboratory test results or any interpretation, advice, or outcomes. We make no warranty regarding the quality or effectiveness of any information, recommendation, product, or service.
Exclusion of Liability
If you rely on, purchase, or use any product, therapy, or modality, you do so at your own risk. We do not guarantee results within a fixed timeframe, as each individual responds differently.
To the maximum extent permitted by law, we exclude all liability for:
● any direct or indirect loss arising from our services
● reliance on laboratory results or recommendations
● use of supplements, products, or therapies
● any failure to identify a medical condition or disease
This limitation applies to all damages, including direct, indirect, incidental, or consequential damages.
No recommendation
All material and information we provide about products and therapies are for educational purposes only and are not endorsements or recommendations.
Commitment/Expectations
As the Client, I understand that my commitment to the services rendered is essential to achieving results.
I understand and agree that:
● no refunds or early terminations will be granted after agreement is signed and test kits have been ordered
● payments will not be paused or held due to lack of participation
● services may be discontinued at the practitioner’s discretion if commitment is not upheld
As the Client, I can expect:
● communication within a reasonable timeframe
● punctual appointments
● professional, judgment-free service
● clear guidance and accountability
Program Duration, Continuation and Membership Transition
The COREFIT 90 Day Metabolism Reset Program includes an initial commitment of four (4) months of coaching, guidance, and support. The Client acknowledges that this program is structured as a step-based process, not a time-based outcome, and that progress may vary based on adherence, consistency, and individual health factors.
Upon completion of the initial four (4) month period, the Client will automatically continue into ongoing coaching services on a month-to-month basis beginning in month five (5), unless cancelled in accordance with these terms.
This continuation includes:
● ongoing coaching and support
● monthly billing of $499
● billing in the same currency as the original purchase (USD or CAD)
Ongoing coaching will continue until:
● the Client provides notice of cancellation in accordance with the cancellation policy; or
● the Client transitions into the maintenance program outlined below
The Client understands and agrees that:
● results are dependent on adherence to the CORE Steps
● results are not guaranteed within a specific timeframe
● achieving desired results may require continued participation beyond the initial program period
Once the Client has achieved their desired results, as reasonably determined based on progress and coaching assessment, the Client will automatically be transitioned into the COREFIT alumni and maintenance program, Hormone Goddess, at a rate of $69 per month.
This membership includes:
● continued support for foundational CORE Steps, including nutrition and movement
● access to group coaching calls
● ongoing structure and accountability
● access to functional lab testing on an a la carte basis
This membership is designed to support long-term maintenance and consistency
Results Guarantee and Continuation Acknowledgment
The Client acknowledges that the COREFIT program is structured around a defined set of steps known as the CORE Steps and that results-based statements are contingent upon full and consistent adherence to the program guidelines, coaching, and recommendations.
The Client understands and agrees that:
● no specific outcome, including weight loss or timeframe, is guaranteed
● the initial four (4) month program period is not a guarantee of completion or results
● continued participation beyond the initial program period may be required to achieve desired outcomes
The Client further acknowledges that if results are not achieved within the initial program period, continued participation in the ongoing coaching structure at the applicable monthly rate is required in order to continue working toward those results. Continued services are not provided free of charge.
Continuation of Services
If the Client continues working with Michele Scarlet Inc. beyond the originally stated program duration or term, such continuation will be governed by these Terms of Service unless otherwise specified in writing. Email confirmation, electronic acceptance, or payment for continued services constitutes agreement to all applicable terms. No additional signed contract is required.
Refund & Cancellation Policy
By purchasing any COREFIT program, I acknowledge and agree that:
● all sales are final
● no refunds will be issued under any circumstances
● the program is not sold as a trial ● there are no cancellations or early terminations of payment plans
● Michele Scarlet Inc. is authorized to charge my card on a recurring basis as agreed
● all charges are non-refundable with no exceptions
Agreement
By proceeding with this purchase, I confirm that I have read, understood, and agreed to these
terms. Entering or typing my name in the signature field constitutes signing this document and
confirming agreement to the terms and conditions stated.
